General conditions
Assumptions and commercial conditions:
- The withdrawal schedule must be done 48 hours in advance, and the delivery schedule must be done 48 hours after the tax document is released. Every service request must be carried out via Customer Service with a minimum of 48 hours.
- For any service not mentioned in the items above, it will be necessary to request a new quote.
- Quotation valid after acceptance as stated above. Amounts subject to variation according to ANTT Resolution No. 5,820, of May 30, 2018, due to the provisions of §3 of art. 5 of Law no. 13,703, of August 8, 2018.
- Rates subject to change due to diesel variation and automatic transfer of toll readjustment if any.
- Advalorem may be exempt if DDR and PGR are approved prior to service/collection request.
- In case of partial DDR, only RCTR-C insurance will be charged.
- For urgent transport (same day collection), collection or delivery on weekends and holidays or outside business hours (from 8:00 am to 5:00 pm) an overtime of 50% of the Shipping Weight + Helper + Escort (when applicable).
- In the case of cargo not collected due to customer failure and/or in case of cancellation after the start of the operation, 100% of the Freight Weight + Tolls will be charged, plus ISS.
- Escort and helpers not included. Values to be confirmed.
- The start of counting of the stay will take place at the time of the appointment. In case of delay, the start of the count will take place when the vehicle arrives at the collection point.
- The end of the stay will be counted at the time of departure from the collection point and the time reference will be made by our logistics management system.
- The parties may agree on new prices and forms of adjustment if there is a proven contractual imbalance between the prices charged and the effective provision of services, with the aim of always maintain the economic and financial balance of the relationship.
- Payment term to be agreed, will only be granted after credit analysis.
- The commercial conditions provided for in this proposal are guaranteed for a period of 15 calendar days, counting from the date of issue (date of the proposal).
- Proposal does not include dangerous goods.
- (*) The customer must schedule the demand service monthly and weekly as follows:
- By the 15th (fifteenth) of each month, the CLIENT will send the CONTRACTOR the schedule for the following month, informing the weekly quantities to be transported.
- Every Wednesday of the month, the CONTRACTOR and/or its subcontractor and the CLIENT shall refine the weekly schedule sent previously in order to indicate the daily schedule for the following week (s + 1).
- After confirmation of the demand (items A and B above), the CONTRACTOR and/or its subcontractor will send the operational schedule with the activities and deadlines of each stage of the process.
- (*) Failure by the CLIENT to comply with the items mentioned in clause 16, may impact the lack of service or even loss of shipment of the cargo, therefore any costs caused by this, will not be assumed by the CONTRACTOR.
- If any item not mentioned above is required, a new quotation will be required.
- Any costs caused by the lack of release of the cargo for delivery at the port terminal are not included in the proposal, as they cannot be assumed by the CONTRACTOR.
- Vehicles will be removed from the plant as soon as the 3rd period ends and may remain waiting at the plant if the spawning or unloading operation has started before the end of the last period.
(*) Applicable only for Brado rail operations
Extra cost
- In the event of an extra cost (additional stay or transport or other costs), the amount will be invoiced via Service Invoice and is subject to ISS application.
- If the CLIENT cancels a schedule agreed by both, the full amount of the agreed rate for each canceled container will be charged for the dead freight.
- In the case of unfinished operations (collections or deliveries) due to customer failure and/or in case of cancellation less than 24 hours before the schedule (regardless of the beginning of the operation), 100% of the Shipping Weight + Tolls and with ISS surcharge.
- For urgent transport (collection same day of release), collection or delivery on weekends and holidays or outside business hours (from 8:00 to 17:00) will be charged an overtime of 50% of the Shipping Weight + Helper + Escort (when applicable).
- The start of the stay count will take place at the time of the appointment. In the event of a delay, the start of the count will take place when the vehicle arrives at the plant.
- The end of the stay will be counted at the time of departure from the plant and the time reference will be made by the Hamburg Sud Group's logistics management system.
- Billing will be carried out weekly based on these parameters.
- For any extra cost, billing made via Service Invoice and subject to ISS.
